CENTURY BATTERIES 12 DAYS OF CHRISTMAS 2024 PROMOTION

CONDITIONS OF ENTRY

 

  1. Instructions, prizes and information on how to enter this “Promotion” form part of these Conditions of Entry. By entering this Promotion, entrants accept these Conditions of Entry.
  2. The “Promoter” Century Yuasa Batteries Pty Ltd ABN 66 009 685 232 of 37-65 Cobalt Street, Carole Park QLD 4300.
  3. The “Promotional Period” begins Sunday 1st December 2024 at 8.00 am AEST and concludes Thursday 12th December 2024 at 5.00pm AEST.
  4. To be an “Eligible Entrant”, individuals must be over the age of 18, an Australian resident and, during the Promotional Period, respond to the prompted question including the requested imagery as a direct comment on the “Promoter’s Facebook” (https://www.facebook.com/CenturyBatteries/), on the relevant post as detailed in the post copy, after which it shall become an “Eligible Entry”.
  5. By doing so, Eligible Entrants agree to these Conditions of Entry for this Promotion. Entrants may only enter this Promotion once per Facebook account held.
  6. The Promoter reserves the right, at any time, to verify the validity of entries and
    entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  7. Incomplete or indecipherable entries, entries which are not original or breach any third-party intellectual property, entries which are obscene, defamatory, or otherwise does not meet community or safety standards will be deemed invalid.
  8. This Promotion is a game of skill: chance plays no part.
  9. There will be 12 individual daily “Winners” of this Promotion and they shall be judged by the Promoter to have the most creative Eligible Entries on each of the 12 days of the Promotional Period.
  10. The “Prize” for this Promotion is 4 x general admission tickets to the Winner’s chosen Supercars Championship event during 2025, noting this cannot include the Melbourne F1 Grand Prix event. To avoid doubt, there will be 12 Prizes in total.
  11. The Prize pool value is up to AUD$5,000 including GST, depending on which Supercars Championship events the Winners select. The Prize is not transferable or exchangeable. The Prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in the Prize value.
  12. The judging will take place each day during the Promotional Period at 6pm AEST at 33 Oxford Street, Nundah QLD 4012.
  13. The Winners will each be notified by the Promoter’s Facebook private message and by comment on the relevant Promoter’s Facebook post. The Promoter’s decision is final, and no correspondence will be entered into.
  14. Eligible Entrants must check their Facebook Messenger account to see if they have been notified as a Winner. If a Winner does not respond to the Promoter’s notification on their relevant account within 72 Hours, the Prize will be voided. The Promoter takes no responsibility for a Winner/s who does not respond during the designated time frame and consequently forfeits the Prize and their entry will be deemed invalid.
  15. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook.
  16. Posted Comments must not include any swearing, derogatory or racist commentary, inflammatory commentary, imagery or commentary displaying alcohol abuse, imagery including nudity and/or unauthorised commercial communications such as spam and any such posts or comments will be removed by the Promoter.
  17. At all times, Eligible Entrants agree to act in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at https://www.facebook.com/legal/terms.
  18. Employees (and their immediate families) of the Promoter and third parties associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  19. It is a condition of accepting the Prize that the Winners will be required to sign a legal release in a form determined by the Promoter in its absolute discretion. In the event that for any reason whatsoever a Winner does not take an element of the Prize at the time stipulated by the Promoter, then that element of the Prize will be forfeited and cash will not be awarded in lieu of that element of the Prize.
  20. Eligible Entrants if selected as the Winner agree to participate in and cooperate as required with all reasonable media editorial requests from the Promoter relating to the Prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the Prize. It is a condition of accepting the Prize that the Winners must comply with all the conditions of use of the Prize and the Prize supplier’s requirements, indemnities, waivers and similar documents.
  21. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with this Promotion and Prize on the dates and in the manner described in these Conditions of Entry, including but not limited to vandalism, power failures, tempests, natural disasters, pandemic, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion provide the winners with an alternative prize for this Promotion.
  22. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the Prize except for any liability which cannot be excluded by law.
  23. The Promoter collects personal information in order to conduct this Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
  24. The laws of Australia apply to this Promotion to the exclusion of any other law. Eligible Entrants submit to the exclusive jurisdiction of the courts of Australia.
  25. Any questions, comments or complaints regarding the Promotion must be directed to the Promoter at socialmedia@cyb.com.au and not to Facebook.
